1 A BILL FOR AN ACT relating to appropriations; to amend Laws 2019, LB294,
2 sections 23, 24, 49, 50, 51, 92, 98, 99, 102, 105, 110, 130, 147,
3 169, 170, 200, 207, 215, 216, 217, and 244; and Laws 2019, LB297,
4 sections 31 and 43; to define and redefine terms; to provide,
5 change, and eliminate appropriations for operation of state
6 government, state aid, postsecondary education, and capital
7 construction; to provide for transfers of funds; to require reports;
8 to repeal the original sections; and to declare an emergency.
9 Be it enacted by the people of the State of Nebraska,

1 Section 1. DEFINITION OF APPROPRIATION PERIOD.
2 For purposes of this act and any other legislative bill passed by
3 the One Hundred Sixth Legislature, First or Second Session, which
4 appropriates funds, FY2018-19 means the period July 1, 2018, through June
5 30, 2019; FY2019-20 means the period July 1, 2019, through June 30, 2020;
6 FY2020-21 means the period July 1, 2020, through June 30, 2021; FY2021-22
7 means the period July 1, 2021, through June 30, 2022; and FY2022-23 means
8 the period July 1, 2022, through June 30, 2023.
9 Sec. 2. APPROPRIATION LANGUAGE.
10 There are hereby appropriated, for FY2019-20 and FY2020-21, the sums
11 set forth in this act to each agency for each program from the respective
12 funds for the general operations of state government, postsecondary
13 education, capital construction, and state aid, except as otherwise
14 appropriated.
15 Sec. 3. UNEXPENDED BALANCES AND CERTIFIED ENCUMBRANCES.
16 All General Fund appropriations existing on June 30, 2019, in excess
17 of expended and certified encumbrance amounts are hereby lapsed unless
18 otherwise provided. All Cash Fund and Revolving Fund appropriations
19 existing on June 30, 2019, in excess of expended and certified
20 encumbrance amounts are hereby lapsed unless otherwise expressly
21 provided. All certified encumbrance amounts on June 30, 2019, and June
22 30, 2020, are hereby reappropriated for FY2019-20 and FY2020-21,
23 respectively, which amounts shall be in addition to the amounts shown in
24 this act.
25 Sec. 4. REAPPROPRIATION OF BALANCES, FY2019-20 to FY2020-21.
26 In addition to the appropriations set forth in this act, there are
27 hereby reappropriated all unexpended appropriation balances existing on
28 June 30, 2020, for FY2020-21 to the respective agencies, programs, and
29 funds listed in this act, except as otherwise provided in this act.
30 Sec. 5. NEBRASKA ACCOUNTING SYSTEM MANUAL DEFINITIONS.
31 The definitions contained in the Nebraska Accounting System Manual,

1 and any amendments thereto, on file with the Clerk of the Legislature are
2 hereby adopted by the Legislature as the definitions for this act.
3 Sec. 6. DRAWING AND PAYING WARRANTS.
4 The Director of Administrative Services shall draw warrants upon the
5 proper fund in the state treasury for an amount not to exceed the
6 appropriations set forth in this act upon presentation of proper
7 documentation. The State Treasurer shall pay the warrants out of the
8 appropriate funds.

5 Expenditures from this program shall not be restricted to state aid
6 if other expenditures are necessary to fulfill the goals of the
7 Governor's Emergency Aid Program.
