1 A BILL FOR AN ACT relating to postsecondary education; to amend sections
2 79-10,143 and 85-2104, Revised Statutes Cumulative Supplement, 2018;
3 to change eligibility requirements for the Access College Early
4 Scholarship Program Act; to harmonize provisions; to repeal the
5 original sections; and to declare an emergency.
6 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 79-10,143, Revised Statutes Cumulative
2 Supplement, 2018, is amended to read:
3 79-10,143 A parent or guardian of any student enrolled in, or in the
4 process of enrolling in, any school district in the state may voluntarily
5 provide information on any application submitted pursuant to Nebraska
6 law, rules, and regulations regarding the applicant's potential to meet
7 the qualifications for free or reduced-price lunches solely for
8 determining eligibility pursuant to subsection (4) of section 79-238,
9 subsection (2) of section 79-241, section 79-2,131, section 79-2,133,
10 subsection (2) of section 79-611, or subdivision (1)(c) and subsection
11 (3) of section 79-2110, or section 85-2104. Each school district shall
12 process information provided pursuant to this section in the same manner
13 as the district would to determine the qualification status of the
14 student for free or reduced-price meals. Each school district shall
15 comply with the federal Family Educational Rights and Privacy Act of
16 1974, 20 U.S.C. 1232g, as such act and section existed on January 1,
17 2015, and regulations adopted thereunder with regard to any information
18 collected pursuant to this section. If no such information is provided
19 pursuant to this section or on an application for free or reduced-price
20 meals, the student shall be presumed not to qualify for free or reduced-
21 price lunches.
22 Sec. 2. Section 85-2104, Revised Statutes Cumulative Supplement,
23 2018, is amended to read:
24 85-2104 Applications for the Access College Early Scholarship
25 Program shall be prioritized for students qualifying pursuant to
26 subdivision (1) or (2) of this section, and applications for students
27 qualifying only pursuant to subdivision (3) of this section shall only be
28 considered if funds are available after fulfilling the applications for
29 students qualifying pursuant to subdivision (1) or (2) of this section.
30 Priority dates shall be determined by the commission on a term basis. A
31 student who is applying to take one or more courses for credit from a

1 qualified postsecondary educational institution is eligible for the
2 Access College Early Scholarship Program if:
3 (1) Such student has completed the Free Application for Federal
4 Student Aid for the applicable award year and has an expected family
5 contribution which is equal to or less than fifty percent of the maximum
6 expected family contribution to qualify for a Federal Pell Grant in that
7 award year;
8 (1) Such student or the student's parent or legal guardian is
9 eligible to receive:
10 (a) Supplemental Security Income;
11 (b) Supplemental Nutrition Assistance Program benefits;
12 (c) Free or reduced-price lunches under United States Department of
13 Agriculture child nutrition programs;
14 (d) Aid to families with dependent children; or
15 (e) Assistance under the Special Supplemental Nutrition Program for
16 Women, Infants, and Children;
17 (2) The student or the student's parent or legal guardian has
18 experienced an extreme hardship; or
19 (3) Such student is requesting assistance pursuant to the program to
20 cover the cost of tuition and fees for a course that is part of a career
21 plan of study, up to two hundred fifty dollars per term, and the
22 student's family has an annual household income at or below two hundred
23 percent of the federal poverty level.
24 Sec. 3. Original sections 79-10,143 and 85-2104, Revised Statutes
25 Cumulative Supplement, 2018, are repealed.
26 Sec. 4. Since an emergency exists, this act takes effect when
27 passed and approved according to law.
