1 A BILL FOR AN ACT relating to the Nebraska Evidence Rules; to amend
2 section 27-1103, Reissue Revised Statutes of Nebraska; to provide
3 for the admission of expert testimony on eyewitness identification
4 and memory as prescribed; to correct internal references; to
5 harmonize provisions; to provide a duty for the Revisor of Statutes;
6 and to repeal the original section.
7 Be it enacted by the people of the State of Nebraska,

1 Section 1. The testimony of expert witnesses regarding eyewitness
2 identification and memory shall not be categorically prohibited and shall
3 be admitted in any criminal or civil proceeding on the same basis as any
4 other expert testimony under this article.
5 Sec. 2. Section 27-1103, Reissue Revised Statutes of Nebraska, is
6 amended to read:
7 27-1103 These rules and section 1 of this act sections 27-412 to
8 27-415 may be known and cited as the Nebraska Evidence Rules.
9 Sec. 3. The Revisor of Statutes shall assign section 1 of this act
10 to Chapter 27, article 7.
11 Sec. 4. Original section 27-1103, Reissue Revised Statutes of
12 Nebraska, is repealed.
