1 A BILL FOR AN ACT relating to the Livestock Animal Welfare Act; to amend
2 section 54-909, Reissue Revised Statutes of Nebraska; to change
3 provisions relating to ownership, possession, or seizure of animals
4 after conviction or violation of a court order under the act; and to
5 repeal the original section.
6 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 54-909, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 54-909 (1) If a person is convicted of a Class IV felony under
4 section 54-903, the sentencing court shall order such person not to own
5 or possess a livestock animal or an animal as defined by section 28-1008
6 for at least five years after the date of conviction, but such time
7 restriction shall not exceed fifteen years. Any person violating such
8 court order shall be guilty of a Class I misdemeanor.
9 (2) If a person is convicted of a Class I misdemeanor under section
10 54-903 or a Class III misdemeanor under section 54-904, the sentencing
11 court may order such person not to own or possess any livestock animal or
12 animal as defined by section 28-1008 after the date of conviction, but
13 such time restriction, if any, shall not exceed five years. Any person
14 violating such court order shall be guilty of a Class IV misdemeanor.
15 (3) Any livestock animal or animal as defined by section 28-1008
16 involved in a violation of a court order under subsection (1) or (2) of
17 this section shall be subject to seizure by law enforcement.
18 Sec. 2. Original section 54-909, Reissue Revised Statutes of
19 Nebraska, is repealed.
