  1     A BILL FOR AN ACT relating to developmental disabilities services; to
  2         amend section 83-1216.02, Revised Statutes Cumulative Supplement,
  3         2018; to change a termination date; and to repeal the original
  4         section.
  5     Be it enacted by the people of the State of Nebraska,

  1           Section      1.        Section      83-1216.02,         Revised Statutes Cumulative
  2     Supplement, 2018, is amended to read:
  3           83-1216.02     (1)      If the department determines that there are not
 4      enough funds available to provide services to all eligible individuals
  5     under subdivision (4)(d) of section 83-1216, the department shall provide
  6     day services to individuals who:
  7           (a)   Are transitioning from the education system upon attaining
  8     twenty-one years of age on or after July 1, 2019; and
  9           (b) Are determined by the department to be otherwise eligible for
10      the day services in    accordance with the Developmental Disabilities
11      Services Act.
12            (2) The department shall provide services comparable to the day
13      services the individual would have received pursuant to subdivision (4)
14      (d) of section 83-1216 if funds were available.
 15           (3) No later than September 15 of each year, the director shall
 16     provide electronic notification to     the Health and Human Services
17      Committee of the Legislature and the Appropriations Committee of the
 18     Legislature of the estimated number of individuals needing services under
 19     subsection    (4)       of section     83-1216     and the net additional resources
20      necessary to    provide services to    all eligible individuals under
 21     subsection (4) of section 83-1216 other than subdivision (f) of such
 22     subsection.
 23           (4) This section terminates June 30, 2025 2021.
 24           Sec. 2.       Original section 83-1216.02, Revised Statutes Cumulative
 25     Supplement, 2018, is repealed.
