1 A BILL FOR AN ACT relating to state government; to require submission of
2 a compilation of the federal receipts of state agencies as
3 prescribed.
4 Be it enacted by the people of the State of Nebraska,

1 Section 1. (1) The office of the Director of Administrative
2 Services shall include in the annual budget report on agency budget
3 requests information that compiles and summarizes the following :
4 (a) The aggregate value of the federal receipts of the agency for
5 the preceding fiscal year;
6 (b) The aggregate amount of federal funds appropriated to the agency
7 by the Legislature for the preceding fiscal year;
8 (c) The percentage of the agency’s total budget for the preceding
9 fiscal year that constitutes federal receipts received by the agency for
10 that fiscal year;
11 (d) A description of any requirement for a state match, including a
12 memorandum of understanding, a maintenance-of-effort agreement, or a
13 contract, entered into with any federal entity to receive federal
14 receipts for the preceding fiscal year detailing the obligations imposed
15 on the state agency, including any state monetary match requirements, the
16 number of full-time or part-time positions obligated by the agreement,
17 and a description of any other resources and obligations incurred by the
18 state agency, and the citation to the applicable federal law, regulation,
19 or grant provision;
20 (e) An operating plan in the event that the federal receipts are
21 reduced by ten percent or more but less than twenty-five percent from the
22 preceding fiscal year which describes the program, activity, or
23 expenditure type that would be impacted by the reduction and if the
24 reduction would require a change in statute, rule, or regulation; a
25 description of the impact of such a reduction on any recipient of the
26 federal receipts, including a state or local agency, and what changes to
27 any program, activity, expenditure, or fee that would be made if the
28 reduction were implemented; and in the event of such a reduction, whether
29 there are mandated federal services that the state would be required to
30 maintain even if the federal receipts were reduced and whether there are
31 other resources available to maintain the services; and

1 (f) An operating plan in the event that the federal receipts are
2 reduced by twenty-five percent or more from the preceding fiscal year
3 which describes the program, activity, or expenditure type that would be
4 impacted by the reduction and if the reduction would require a change in
5 statute, rule, or regulation; a description of the impact of such a
6 reduction on any recipient of the federal receipts, including a state or
7 local agency, and what changes to any program, activity, expenditure, or
8 fee that would be made if the reduction were implemented; and in the
9 event of such a reduction, whether there are mandated federal services
10 that the state would be required to maintain even if the federal receipts
11 were reduced and whether there are other resources available to maintain
12 the services.
13 (2) For purposes of this section, federal receipts means any
14 financial assistance which is received from the United States Government
15 or any agency thereof and which is required to be submitted to the budget
16 request and reporting system of the Department of Administrative
17 Services, whether received by contract, grant subsidy, augmentation, or
18 reimbursement or by any other form.
