1 A BILL FOR AN ACT relating to the Office of Inspector General of the
2 Nebraska Correctional System Act; to amend section 47-913, Revised
3 Statutes Cumulative Supplement, 2018; to require the Department of
4 Correctional Services to provide access to certain records; to
5 define a term; and to repeal the original section.
6 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 47-913, Revised Statutes Cumulative Supplement,
2 2018, is amended to read:
3 47-913 (1) The department shall provide the Public Counsel and the
4 Inspector General with direct computer access to all computerized
5 records, reports, and documents maintained by the department in
6 connection with administration of the Nebraska correctional system,
7 except that the Public Counsel's and Inspector General's access to an
8 inmate's medical or mental health records shall be subject to the
9 inmate's consent.
10 (2) The department shall also provide the Public Counsel and the
11 Inspector General with access to all documents or information submitted
12 for entry into the department's criminal information data base. This
13 includes documents and information submitted by department staff and
14 related to activity or action that has taken place within departmental
15 correctional facilities. This also includes physical documents maintained
16 by department staff to document what has been submitted for entry into
17 the data base.
18 (3) This section does not require the department to provide access
19 to documents or information collected and submitted for entry into the
20 data base by local, state, and federal law enforcement agencies.
21 (4) For purposes of this section, criminal information data base
22 means a data base developed, maintained, and secured by the department
23 that includes intelligence information.
24 Sec. 2. Original section 47-913, Revised Statutes Cumulative
25 Supplement, 2018, is repealed.
