1 A BILL FOR AN ACT relating to autocycles, motorcycles, and mopeds; to
2 amend section 60-6,279, Revised Statutes Cumulative Supplement,
3 2018; to change helmet provisions; to require eye protection; and to
4 repeal the original section.
5 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 60-6,279, Revised Statutes Cumulative Supplement,
2 2018, is amended to read:
3 60-6,279 (1) A person shall not operate an autocycle, a motorcycle,
4 or moped on any highway in this state unless such person is wearing eye
5 protection.
6 (2) Except as otherwise provided in subsections (3) and (4) of this
7 section, a A person shall not operate or be a passenger in an autocycle
8 described in subsection (5) (2) of this section, on a motorcycle other
9 than an autocycle, or on a moped on any highway in this state unless such
10 person is wearing a protective helmet of the type and design manufactured
11 for use by operators of such vehicles and unless such helmet is secured
12 properly on his or her head with a chin strap while the vehicle is in
13 motion. All such protective helmets shall be designed to reduce injuries
14 to the user resulting from head impacts and shall be designed to protect
15 the user by remaining on the user's head, deflecting blows, resisting
16 penetration, and spreading the force of impact. Each such helmet shall
17 consist of lining, padding, and chin strap and shall meet or exceed the
18 standards established in the United States Department of Transportation's
19 Federal Motor Vehicle Safety Standard No. 218, 49 C.F.R. 571.218, for
20 motorcycle helmets.
21 (3) A person who is at least twenty-one years of age is exempt from
22 subdivision (2) of this section.
23 (4) For purposes of this section, eye protection means glasses that
24 cover the orbital region of a person's face, a protective face shield
25 attached to a protective helmet, goggles, or a windshield on the
26 motorcycle or moped that protects the operator's and passenger's
27 horizontal line of vision in all operating positions.
28 (5) (2) This section applies to an autocycle that has a seating area
29 that is not completely enclosed.
30 Sec. 2. Original section 60-6,279, Revised Statutes Cumulative
31 Supplement, 2018, is repealed.
