1 A BILL FOR AN ACT relating to the Adult Protective Services Act; to amend
2 section 28-351, Reissue Revised Statutes of Nebraska; to redefine
3 abuse to include assaults; and to repeal the original section.
4 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 28-351, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 28-351 Abuse means any knowing or intentional act on the part of a
4 caregiver or any other person which results in physical injury,
5 unreasonable confinement, cruel punishment, sexual abuse, or sexual
6 exploitation of a vulnerable adult. Such act shall constitute abuse
7 regardless of whether it impairs physical functions of the victim and
8 regardless of whether the victim reports such act or seeks medical
9 attention or treatment.
10 Sec. 2. Original section 28-351, Reissue Revised Statutes of
11 Nebraska, is repealed.
