1 A BILL FOR AN ACT relating to government; to amend sections 13-801 and
2 13-2501, Reissue Revised Statutes of Nebraska; to prohibit joint
3 entities formed under the Interlocal Cooperation Act and joint
4 public agencies formed under the Joint Public Agency Act from taking
5 action against members or representatives for engaging in free
6 speech as prescribed; to harmonize provisions; and to repeal the
7 original sections.
8 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 13-801, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 13-801 Sections 13-801 to 13-827 and section 2 of this act shall be
4 known and may be cited as the Interlocal Cooperation Act.
5 Sec. 2. A joint entity shall not prohibit a representative of its
6 members or of any joint board from, or censure such representative for,
7 expressing his or her opinion or speaking on any matter related to the
8 joint entity or joint board if such speech is otherwise lawful.
9 Sec. 3. Section 13-2501, Reissue Revised Statutes of Nebraska, is
10 amended to read:
11 13-2501 Sections 13-2501 to 13-2550 and section 4 of this act shall
12 be known and may be cited as the Joint Public Agency Act.
13 Sec. 4. A joint public agency shall not prohibit a representative
14 of its member public agencies or of any board from, or censure such
15 representative for, expressing his or her opinion or speaking on any
16 matter related to the joint public agency or board if such speech is
17 otherwise lawful.
18 Sec. 5. Original sections 13-801 and 13-2501, Reissue Revised
19 Statutes of Nebraska, are repealed.
