1 A BILL FOR AN ACT relating to the Department of Health and Human
2 Services; to require conditions for certain grant funding; and to
3 provide a duty for the Revisor of Statutes.
4 Be it enacted by the people of the State of Nebraska,

1 Section 1. The Department of Health and Human Services shall only
2 grant funds received under 42 U.S.C. 300 et seq., for population research
3 and voluntary family planning programs, to entities that are:
4 (1) Licensed under the Health Care Facility Licensure Act and
5 provide service to recipients of medical assistance under the Medical
6 Assistance Act;
7 (2) Compliant with the provisions of the federal Health Insurance
8 Portability and Accountability Act of 1996, and any regulations
9 promulgated under such federal act;
10 (3) Able to diagnose and treat sexually transmitted diseases and
11 infections; and
12 (4) Able to provide gynecological exams.
13 Sec. 2. The Revisor of Statutes shall assign section 1 of this act
14 to Chapter 81, article 6.
