1 A BILL FOR AN ACT relating to the Nebraska Litter Reduction and Recycling
2 Act; to amend section 81-1566, Reissue Revised Statutes of Nebraska,
3 and section 81-1558, Revised Statutes Cumulative Supplement, 2018;
4 to eliminate provisions relating to transfers; to extend a
5 termination date; and to repeal the original sections.

1 Section 1. Section 81-1558, Revised Statutes Cumulative Supplement,
2 2018, is amended to read:
3 81-1558 There is hereby created within the state treasury a fund to
4 be known as the Nebraska Litter Reduction and Recycling Fund. The
5 proceeds of the fee imposed by sections 81-1559 to 81-1560.02, money
6 received by the department as gifts, donations, or contributions toward
7 the goals stated in section 81-1535, and money received by the department
8 for nonprofit activities concerning litter reduction and recycling,
9 including, but not limited to, honoraria, literature furnished by the
10 department, and funds realized as reimbursement for expenses in
11 conducting educational forums, shall be remitted to the State Treasurer
12 for credit to such fund to be used for the administration and enforcement
13 of the Nebraska Litter Reduction and Recycling Act. Transfers may be made
14 from the fund to the General Fund at the direction of the Legislature.
15 Any money in the Nebraska Litter Reduction and Recycling Fund available
16 for investment shall be invested by the state investment officer pursuant
17 to the Nebraska Capital Expansion Act and the Nebraska State Funds
18 Investment Act.
19 Sec. 2. Section 81-1566, Reissue Revised Statutes of Nebraska, is
20 amended to read:
21 81-1566 The Nebraska Litter Reduction and Recycling Act shall
22 terminate on September October 30, 2025 2020, unless extended by the
23 Legislature. In order to determine whether such extension shall occur,
24 the department shall review and evaluate the extent to which the purposes
25 of the act have been and are being achieved and the need for continuation
26 of the program and requirements established by the act. Such review and
27 evaluation shall be completed at least six months prior to the date
28 established by this section for termination of the act.
29 Sec. 3. Original section 81-1566, Reissue Revised Statutes of
30 Nebraska, and section 81-1558, Revised Statutes Cumulative Supplement,
31 2018, are repealed.
