1 A BILL FOR AN ACT relating to the Public Counsel; to amend section
2 28-376, Reissue Revised Statutes of Nebraska; to provide access to
3 the Adult Protective Services Central Registry as prescribed; and to
4 repeal the original section.
5 Be it enacted by the people of the State of Nebraska,

1 Section 1. Section 28-376, Reissue Revised Statutes of Nebraska, is
2 amended to read:
3 28-376 (1) The department shall establish and maintain an Adult
4 Protective Services Central Registry which shall contain any
5 substantiated report regarding a person who has allegedly abused,
6 neglected, or exploited a vulnerable adult.
7 (2) Upon request, a vulnerable adult who is the subject of a report
8 or, if the vulnerable adult is legally incapacitated, the guardian or
9 guardian ad litem of the vulnerable adult and the person who has
10 allegedly abused, neglected, or exploited the vulnerable adult shall be
11 entitled to receive a copy of all information contained in the registry
12 pertaining to such report. The department shall not release data that
13 would be harmful or detrimental to the vulnerable adult or that would
14 identify or locate a person who, in good faith, made a report or
15 cooperated in a subsequent investigation unless ordered to do so by a
16 court of competent jurisdiction.
17 (3) The department shall establish classifications for all cases in
18 the registry.
19 (4) The department shall determine whether a name-change order
20 received from the clerk of a district court pursuant to section 25-21,271
21 is for a person on the Adult Protective Services Central Registry and, if
22 so, shall include the changed name with the former name in the registry
23 and file or cross-reference the information under both names.
24 (5) The department shall provide access to any data contained in the
25 Adult Protective Services Central Registry to the Public Counsel on
26 request.
27 Sec. 2. Original section 28-376, Reissue Revised Statutes of
28 Nebraska, is repealed.
