This bill proposes the creation of Chapter 44-04.1 of the North Dakota Century Code, which aims to prohibit state agencies from entering into nondisclosure agreements (NDAs) concerning data centers and industrial projects. The bill defines key terms such as "agency," "data center," "developer," and "industrial project," and outlines the specific conditions under which NDAs are deemed unacceptable. It states that agencies cannot enter NDAs that restrict the disclosure of information related to these projects, including details about location, construction, and environmental impacts. Any NDA entered into in violation of this chapter would be considered void and unenforceable.

Additionally, the bill establishes that developers must declare under penalty of perjury that they have not entered into any NDAs that violate this chapter as part of their application to an agency. Violations can lead to the suspension or revocation of permits or approvals, and agencies that breach this law may face civil penalties of up to one thousand dollars per violation. The act will take effect upon filing with the secretary of state and will remain in effect until June 30, 2027.
