1 A BILL for an Act to create and enact two new sections to chapter 54-44 of the North Dakota
2 Century Code, relating to services provided to occupational and professional boards; and to
3 amend and reenact sections 6-09-07 and 54-59-01 of the North Dakota Century Code, relating
4 to occupational and professional board financial and information technology requirements.
5 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
6 SECTION 1. AMENDMENT. Section 6-09-07 of the North Dakota Century Code is amended
7 and reenacted as follows:
8 6-09-07. State funds must be deposited in Bank of North Dakota - Income of the Bank.
9 All state funds, except funds of occupational and professional boards, and funds of all state
10 penal, educational, and industrial institutions must be deposited in the Bank of North Dakota by
11 the personsindividuals having control of such funds or must be deposited in accordance with
12 constitutional and statutory provisions. All income earned by the Bank for its own account on
13 state moneys that are deposited in or invested with the Bank to the credit of the state must be
14 credited to and become a part of the revenues and income of the Bank.
15 SECTION 2. A new section to chapter 54-44 of the North Dakota Century Code is created
16 and enacted as follows:
17 Occupational and professional board administrative services.
18 The office of management and budget shall provide administrative services to all
19 occupational and professional boards. The office of management and budget shall collaborate
20 with each occupational or professional board to provide the following administrative services:
21 1. Licensure application processing subject to board approval;
22 2. Documentation and auditing of continuing education of licensed individuals;
23 3. Budgeting and other financial services, including processing of licensure and other fee
24 payments;

1 4. Human resource services, including assistance with payroll functions;
2 5. Procurement and contracting services pursuant to chapter 54-44.4;
3 6. Records management pursuant to chapter 54-46; and
4 7. Coordination of information technology services provided by the information
5 technology department pursuant to chapter 54-59.
6 SECTION 3. A new section to chapter 54-44 of the North Dakota Century Code is created
7 and enacted as follows:
8 Coordination of occupational and professional board services.
9 The office of management and budget shall collaborate with the attorney general,
10 information technology department, and workforce safety and insurance to ensure appropriate
11 legal, information technology, and insurance services are provided to all occupational and
12 professional boards to meet the needs of each board, create efficiencies, and simplify licensing
13 and reciprocity requirements.
14 SECTION 4. AMENDMENT. Section 54-59-01 of the North Dakota Century Code is
15 amended and reenacted as follows:
16 54-59-01. Definitions.
17 As used in this chapter:
18 1. "Agency" or "entity" does not include any agricultural commodity promotion group or
19 any occupational or professional board.
20 2. "Cybersecurity" means processes or capabilities, wherein, systems, communications,
21 and information are protected and defended against damage, unauthorized use or
22 modification, and exploitation.
23 3. "Cybersecurity strategy" means a vision, plan of action, or guiding principles. Unless
24 otherwise defined in this chapter, the term does not mean an associated operational
25 plan.
26 4. "Department" means the information technology department.
27 5. "Information technology" means the use of hardware, software, services, and
28 supporting infrastructure to manage and deliver information using voice, data, and
29 video.
30 6. "Network services" means the equipment, software, and services necessary to
31 transmit voice, data, or video.
