1 A BILL for an Act to create and enact a new section to chapter 16.1-08.1 of the North Dakota
2 Century Code, relating to campaign contribution limitations in legislative races; to amend and
3 reenact subsection 4 of section 16.1-08.1-02.3, subsection 4 of section 16.1-08.1-02.4, and
4 section 16.1-08.1-03.14 of the North Dakota Century Code, relating to campaign disclosure
5 statements; and to provide a penalty.
6 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
7 SECTION 1. A new section to chapter 16.1-08.1 of the North Dakota Century Code is
8 created and enacted as follows:
9 Contributions to legislative candidate's campaign committee - Limitation.
10 1. A legislative candidate or the candidate's campaign committee may accept
11 contributions during any calendar year as follows:
12 a. Not to exceed one thousand dollars from an individual, unless the individual is
13 the candidate or a member of the candidate's immediate family, in which case
14 contributions may be made without limit;
15 b. Not to exceed one thousand dollars from a political committee, except a
16 contribution may be made from a candidate committee without limit; or
17 c. Without limit from a political party.
18 2. A violation of this section is a class B misdemeanor. A subsequent offense within a
19 calendar year is a class A misdemeanor.
20 SECTION 2. AMENDMENT. Subsection 4 of section 16.1-08.1-02.3 of the North Dakota
21 Century Code is amended and reenacted as follows:
22 4. A person required to file a statement under this section, other than a candidate for
23 judicial office, county office, or city office, or a candidate committee for a candidate
24 exempted under this subsection, shall report each aggregated contribution from a

1 contributor which totals fiveone thousand dollars or more during the reporting period.
2 For these contributions from individuals, the statement must include the contributor's
3 occupation, employer, and the employer's principal place of business.
4 SECTION 3. AMENDMENT. Subsection 4 of section 16.1-08.1-02.4 of the North Dakota
5 Century Code is amended and reenacted as follows:
6 4. A person required to file a statement under this section shall disclose each aggregated
7 contribution from a contributor which totals fiveone thousand dollars or more during
8 the reporting period. For these contributions from individuals, the statement must
9 include the contributor's occupation, employer, and the employer's principal place of
10 business.
11 SECTION 4. AMENDMENT. Section 16.1-08.1-03.14 of the North Dakota Century Code is
12 amended and reenacted as follows:
13 16.1-08.1-03.14. Conduit required to provide detailed contribution information to
14 recipient.
15 A conduit that transfers any contribution to a candidate, political party, or political committee
16 shall provide the recipient of the contribution a detailed statement that lists the name and
17 address of each individual contributor, the amount of each contribution, and the date each
18 contribution was received. The conduit also shall include on the statement the occupation,
19 employer, and principal place of business of each contributor, or the political committee if not
20 already registered according to state or federal law, which contributed fiveone thousand dollars
21 or more in the aggregate during a reporting period applicable to the candidate, political party, or
22 political committee. The conduit shall provide the statement to the candidate, political party, or
23 political committee in a manner to allow the candidate, political party, or political committee to
24 file any statement required to be filed under this chapter.
