1 A BILL for an Act to create and enact a new section to chapter 4.1-03 of the North Dakota
2 Century Code, relating to beef commission member appointments; and to amend and reenact
3 section 4.1-03-02 of the North Dakota Century Code, relating to applicants for membership on
4 the beef commission.
5 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
6 SECTION 1. AMENDMENT. Section 4.1-03-02 of the North Dakota Century Code is
7 amended and reenacted as follows:
8 4.1-03-02. North Dakota beef commission - Membership - Applications -
9 Qualifications.
10 1. The North Dakota beef commission consists of:
11 a. Three beef producers;
12 b. One cattle feeder;
13 c. One dairy producer;
14 d. One representative of a public livestock market; and
15 e. Three at-large representatives.
16 2. The governor shall appoint:
17 a. Each beef producer from a list of at least two names submitted by the North
18 Dakota stockmen's association;
19 b. The cattle feeder from a list of at least two names submitted by the North Dakota
20 stockmen's association feeder council;
21 c. The dairy producer from a list of at least two names submitted by the milk
22 producers association of North Dakota;
23 d. The representative of a public livestock market from a list of at least two names
24 submitted by the North Dakota livestock marketing association; and

1 e. The three at-large representatives.
2 3. Each individual seeking membership as an at-large representative shall complete and
3 submit an application in accordance with section 2 of this Act. In a year in which an
4 at-large representative term is scheduled to expire, the application period opens on
5 March first and closes on May first.
6 3.4. a. Each member of the commission must:
7 (1) Be a United States citizen and a resident of this state;
8 (2) Be actively engaged in that phase of the cattle industry the member
9 represents; and
10 (3) Have been actively engaged in that phase of the cattle industry for a period
11 of five years.
12 b. Each member of the commission, except the representative of a public livestock
13 market, must be a participating producer.
14 c. For purposes of this subsection, "actively engaged" means that the individual:
15 (1) Has an ownership interest in an operation that is of sufficient scope and
16 significance as to constitute a distinct activity; and
17 (2) Has and regularly exercises direct control of the operation.
18 SECTION 2. A new section to chapter 4.1-03 of the North Dakota Century Code is created
19 and enacted as follows:
20 At-large representatives - Expiring terms - Notice.
21 1. When the term of an at-large representative is scheduled to expire, the commission
22 shall publish a notification, beginning in March of that year, once per month for two
23 consecutive months in the official newspaper of each county. The notification must
24 include:
25 a. A statement indicating applications are being accepted for an at-large
26 representative member on the commission;
27 b. Instructions for obtaining an application form;
28 c. The deadline to submit an application;
29 d. Submission instructions for a completed application; and
30 e. The length of the term of office.

1 2. Beginning on March first, the commission shall post on the commission's website a
2 notification that includes the information provided in subsection 1 in a year when the
3 term of an at-large representative is scheduled to expire. The notification must remain
4 posted until the application period closes.
