1 A concurrent resolution to create and enact a new section to article I of the Constitution of North
2 Dakota, relating to the legalization of cannabis; and to provide an effective date.
3 STATEMENT OF INTENT
4 This measure would legalize the use and sale of cannabis for individuals who are twenty-one
5 years of age or older and provides these changes will take effect on August 1, 2023.
6 BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF NORTH DAKOTA, THE
7 SENATE CONCURRING THEREIN:
8 That the following proposed new section to article I of the Constitution of North Dakota is
9 agreed to and must be submitted to the qualified electors of North Dakota at the general
10 election to be held in 2022, in accordance with section 16 of article IV of the Constitution of
11 North Dakota.
12 SECTION 1. A new section to article I of the Constitution of North Dakota is created and
13 enacted as follows:
14 1. As used in this section, "cannabis" means all parts of the plant genus cannabis L.,
15 whether growing or dry; the seeds of the plant; the resin extracted from any part of the
16 plant; and every compound, manufacture, salt, derivative, mixture, or preparation of
17 the plant, the seeds of the plant, or the resin extracted from the plant, including
18 cannabis concentrate. "Cannabis" does not include cannabis dispensed and
19 consumed for medical purposes pursuant to any law enacted by the legislative
20 assembly or hemp or hemp products.
21 2. An individual twenty-one years of age or older may grow, cultivate, process,
22 manufacture, prepare, package, transfer, sell, consume, and purchase cannabis or
23 products created from or which include cannabis.

1 3. At least twenty-five percent of all state taxes collected from the sale and use of
2 cannabis must be designated by the legislative assembly for drug education and
3 treatment purposes.
4 SECTION 2. EFFECTIVE DATE. If approved by the electors, this measure becomes
5 effective on August 1, 2023.
