1 A concurrent resolution directing the Legislative Management to consider studying the fiscal and
2 safety impacts of United States Fish and Wildlife Service easements in North Dakota on the
3 Department of Transportation, Department of Agriculture, and counties.
4 WHEREAS, the United States Fish and Wildlife Service owns perpetual easements in North
5 Dakota, including easements adjacent to roadways; and
6 WHEREAS, the United States Fish and Wildlife Service may impose regulatory
7 requirements on state agencies and political subdivisions constructing or improving roads or
8 engaging in other projects when the United States Fish and Wildlife Service deems its interests
9 would be impacted by the projects; and
10 WHEREAS, the imposition of federal requirements may delay or otherwise negatively
11 impact the construction and improvement of roads or other projects in North Dakota; and
12 WHEREAS, delays and other impacts from federal requirements may impede road
13 improvements and repairs necessary for public safety and increase the cost of construction to
14 the state and political subdivisions;
15 NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF
16 NORTH DAKOTA, THE SENATE CONCURRING THEREIN:
17 That the Legislative Management consider studying the fiscal and safety impacts of United
18 States Fish and Wildlife Service easements in North Dakota on the Department of
19 Transportation, Department of Agriculture, and counties.
20 BE IT FURTHER RESOLVED, that the Legislative Management reports its findings and
21 recommendations, together with any legislation required to implement the recommendations, to
22 the Sixty-eighth Legislative Assembly.
