1 A concurrent resolution urging Congress to propose an amendment to the United States
2 Constitution to prohibit changing the number of justices serving on the United States Supreme
3 Court.
4 WHEREAS, an independent United States Supreme Court is an essential element of
5 America's system of checks and balances that protects individuals' constitutional rights;
6 WHEREAS, the United States Supreme Court has been composed of nine justices for more
7 than 150 years;
8 WHEREAS, the President of the United States and Congress should be prohibited from
9 undermining the independence of the United States Supreme Court by changing the number of
10 justices on the United States Supreme Court;
11 NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF
12 NORTH DAKOTA, THE SENATE CONCURRING THEREIN:
13 That the Sixty-seventh Legislative Assembly urges Congress to propose an amendment to
14 the United States Constitution to prohibit changing the number of justices serving on the United
15 States Supreme Court; and
16 BE IT FURTHER RESOLVED, that the Secretary of State forward copies of this resolution
17 to the President of the United States, the Majority and Minority Leaders of the United States
18 Senate and the United States House of Representatives, and each member of the North Dakota
19 Congressional Delegation.
