1 A concurrent resolution declaring the state will obey only the federal laws, agency rules, or
2 presidential executive orders the state determines to be constitutional.
3 WHEREAS, the Tenth Amendment of the Constitution of the United States provides the
4 powers not delegated to the United States by the Constitution, nor prohibited by it to the states,
5 are reserved to the states respectively, or to the people; and
6 WHEREAS, Section 2 of Article I of the Constitution of North Dakota provides "all political
7 power is inherent in the people. Government is instituted for the protection, security and benefit
8 of the people, and they have a right to alter or reform the same whenever the public good may
9 require"; and
10 WHEREAS, the state reserves the right to evaluate federal laws, agency rules, or
11 presidential executive orders for their constitutionality; and
12 WHEREAS, some federal laws, agency rules, or presidential executive orders are not in the
13 best interest of the citizens of North Dakota;
14 NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF
15 NORTH DAKOTA, THE SENATE CONCURRING THEREIN:
16 That the Sixty-seventh Legislative Assembly declares the state will obey only the federal
17 laws, agency rules, or presidential executive orders the state determines to be constitutional;
18 and
19 BE IT FURTHER RESOLVED, that the Secretary of State forward copies of this resolution
20 to the President of the United States and to each member of the North Dakota Congressional
21 Delegation.
