1 A BILL for an Act to amend and reenact section 43-15-31.5 of the North Dakota Century Code,
2 relating to permitting pharmacy technician to administer drugs under the authority of a
3 pharmacist.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. AMENDMENT. Section 43-15-31.5 of the North Dakota Century Code is
6 amended and reenacted as follows:
7 43-15-31.5. Administration of drugs - Rules.
8 A pharmacist who administers drugs must have authority from the board. The authority to
9 administer a drug may not be delegated. The board shall adopt rules to establish educational
10 and operational requirements for a pharmacist to obtain and maintain authority to administer
11 drugs. The board may adopt rules to establish educational and operational requirements to
12 allow a pharmacy technician to administer a drug under the immediate personal supervision
13 and control of a pharmacist. Rules adopted by the board under this section must include:
14 1. Educational requirements, which include, at a minimum:
15 a. Basic immunology, including the human immune response;
16 b. The mechanism of immunity, adverse effects, dose, and administration schedule
17 of available vaccines and approved medication and immunization;
18 c. Current immunization guidelines and recommendations of the centers for disease
19 control and prevention;
20 d. Management of adverse events, including identification, appropriate response,
21 documentation, and reporting;
22 e. Physiology and techniques of administration of drugs; and
23 f. Recordkeeping requirements established by law, rule, and regulation or
24 established standards of care.

1 2. A requirement an authorized pharmacist shall obtain and maintain current certification
2 in cardiopulmonary resuscitation or basic cardiac life support.
3 3. Requirements for content of practitioner orders and protocols.
4 4. Requirements relating to the reporting of the administration to a patient's primary
5 health care provider and to the state department of health.
6 5. Requirements relating to environments in which drugs may be administered.
