1 A BILL for an Act to create and enact section 44-06.1-31 of the North Dakota Century Code,
2 relating to remote notarial acts for clients of certain nonprofit organizations; to amend and
3 reenact subdivision c of subsection 3 of section 44-06.1-13.1 of the North Dakota Century
4 Code, relating to an exemption for certain remote notarial acts; and to provide a penalty.
5 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
6 SECTION 1. AMENDMENT. Subdivision c of subsection 3 of section 44-06.1-13.1 of the
7 North Dakota Century Code is amended and reenacted as follows:
8 c. TheExcept as provided in section 44-06.1-31, the notary public, or a person
9 acting on behalf of the notary public, creates an audiovisual recording of the
10 performance of the notarial act; and
11 SECTION 2. Section 44-06.1-31 of the North Dakota Century Code is created and enacted
12 as follows:
13 44-06.1-31. Remote notarial acts for certain legal clients.
14 An employee of a nonprofit organization providing legal services to low-income and elderly
15 residents of this state may perform notarial acts under this chapter for clients of the organization
16 who are remotely located without making an audiovisual recording of the performance of the
17 notarial act or the signing of the record to be notarized.
