1 A BILL for an Act to amend and reenact section 15-04-01 of the North Dakota Century Code,
2 relating to the duration of school and public land leases.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Section 15-04-01 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 15-04-01. Leasing of school and other public lands - Rent.
7 1. All lands granted by the United States to this state for the establishment and support
8 of common schools and of educational, penal, or charitable institutions may be leased
9 for pasturage and meadow purposes at public auction after notice as provided by this
10 chapter. The
11 2. A lease under this section may be for a period of not more thanto exceed five years.
12 Grant lands whichthat have never been placed under cultivation by a contract
13 purchaser, in the event suchif the contract is canceled, may be leased for pasturage or
14 meadow purposes for a period of not more thanto exceed five years. Grant lands
15 whichthat have been placed under cultivation by a contract purchaser, inif the event
16 such contract is canceled, may be leased at the discretion and under the control of the
17 board of university and school lands for other than pasturage and meadow purposes
18 until the land is resold.
19 3. All rents are payable annually in advance.
20 4. Notwithstanding subsection 2, if the governor declares a state of emergency under
21 chapter 37-17.1 which impacts the ability of the commissioner to hold a live auction
22 under section 15-04-10, a lease under this section may extend beyond five years.
