1 A BILL for an Act to amend and reenact subsection 5 of section 40-06-09 of the North Dakota
2 Century Code, relating to the number of members of a city governing body; and to repeal
3 section 40-12-01 of the North Dakota Century Code, relating to initiating and referring a
4 municipal ordinance.
5 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
6 SECTION 1. AMENDMENT. Subsection 5 of section 40-06-09 of the North Dakota Century
7 Code is amended and reenacted as follows:
8 5. All statutory provisions relating specifically to a ten-member council or eleven-member
9 council, whether repealed or amended by chapter 401 of the 1993 Session Laws,
10 including sections 40-08-03.1, 40-08-03.2, 40-08-04, 40-08-04.1, and 40-08-06.1, and
11 40-12-01, continue to apply to those councils existing on August 1, 1993, until such
12 time as an increase or decrease occurs in the number of members of those councils
13 pursuant to this section.
14 SECTION 2. REPEAL. Section 40-12-01 of the North Dakota Century Code is repealed.
