1 A BILL for an Act to create and enact a new subsection to section 20.1-03-11 and a new
2 subsection to section 20.1-03-12 of the North Dakota Century Code, relating to licenses to hunt
3 deer; to amend and reenact subsection 2 of section 20.1-08-04 of the North Dakota Century
4 Code, relating to licenses to hunt deer; and to provide a penalty.
5 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
6 SECTION 1. A new subsection to section 20.1-03-11 of the North Dakota Century Code is
7 created and enacted as follows:
8 For purposes of this subsection, a "former resident" is a nonresident who formerly
9 resided in this state for at least ten years regardless of whether the ten years were
10 consecutive. One percent of the total deer licenses and permits to hunt deer with guns
11 to be issued in any unit or subunit as described in the governor's proclamation,
12 including licenses issued to nonresidents under subsections 3 and 4, must be
13 allocated to former residents. An applicant's status as a former resident must be
14 confirmed in accordance with a procedure established by the director. Notwithstanding
15 the number of licenses allocated under this subsection, upon payment of the fee
16 required for a former resident who participates on the same basis as a resident in a
17 lottery for deer licenses remaining after the second lottery for residents, a former
18 resident may participate on the same basis as a resident in a lottery for deer licenses
19 remaining after the second lottery for residents.
20 SECTION 2. A new subsection to section 20.1-03-12 of the North Dakota Century Code is
21 created and enacted as follows:
22 Except for a former resident who participates on the same basis as a resident in a
23 lottery for deer licenses remaining after the second lottery for residents under
24 section 1 of this Act, for a former resident big game hunting license, two hundred fifty

1 dollars, and a nonrefundable five dollar application fee must accompany any lottery
2 license fee under this subsection, except as provided in a gubernatorial proclamation
3 issued pursuant to section 20.1-08-04.1. For a former resident who participates on the
4 same basis as a resident in a lottery for deer licenses remaining after the second
5 lottery for residents, fifty dollars.
6 SECTION 3. AMENDMENT. Subsection 2 of section 20.1-08-04 of the North Dakota
7 Century Code is amended and reenacted as follows:
8 2. The governor in the governor's proclamation or order may determine the number of
9 resident, former resident, and nonresident big game licenses to be issued for the
10 taking of each species, age, or sex. When a limited number of big game licenses or
11 special permits are to be issued, the governor shall by order or proclamation declare
12 the manner of issuance of the licenses and permits. The governor may by
13 proclamation or order determine the time period for which a recipient of a big game
14 license or special permit obtained by lottery is ineligible to apply for the same type of
15 license or special permit.
