1 A BILL for an Act to amend and reenact section 57-32-01 of the North Dakota Century Code,
2 relating to taxes imposed on air carrier transportation companies; and to provide an effective
3 date.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. AMENDMENT. Section 57-32-01 of the North Dakota Century Code is
6 amended and reenacted as follows:
7 57-32-01. Applicability of public utility laws.
8 All of the
9 1. The provisions of chapter 57-06 are made applicable, insofar as the same may be
10 consistent with the provisions ofnot in conflict with this chapter, apply to the
11 assessment of express companies and air transportation companies.
12 2. For purposes of this chapter, an "air carrier transportation company" or "air
13 transportation company" includes any other certified air carrier that:
14 a. Shares a flight designator code with the air carrier transportation company;
15 b. Operates under the same trade name as the air carrier transportation company;
16 or
17 c. Operates under the same livery as the air carrier transportation company.
18 SECTION 2. EFFECTIVE DATE. This Act is effective for taxable years beginning after
19 December 31, 2020.
