1 A BILL for an Act to amend and reenact subsection 1 of section 16.1-07-05 and section
2 16.1-07-07 of the North Dakota Century Code, relating to the application process for an absent
3 voter's ballot.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. AMENDMENT. Subsection 1 of section 16.1-07-05 of the North Dakota
6 Century Code is amended and reenacted as follows:
7 1. At any time in an election year, any qualified elector may apply to the county auditor,
8 the auditor or clerk of the city, or the business manager of the school district, as the
9 case may be, by personal delivery, facsimile, electronic mail or otherwise, for an
10 official ballot to be voted at that election. A voter may obtain an application form
11 approved by the secretary of state, for an absent voter's ballot for a general, special,
12 primary, county, city, or school election from the secretary of state, a county or city
13 auditor, a candidate, a political party, or a political committee. The application form
14 must include a space for the applicant to indicate whether the application is for all
15 statewide elections in the calendar year ormust be only for the election that is
16 immediately after the date of the application.
17 SECTION 2. AMENDMENT. Section 16.1-07-07 of the North Dakota Century Code is
18 amended and reenacted as follows:
19 16.1-07-07. Delivering application form for ballot.
20 The officers specified in section 16.1-07-05, upon request, shall mail an application form for
21 an absent voter's ballot to the voter or may deliver the application form to the voter upon a
22 personal application made at the officer's office. The officers also may also make available or
23 distribute the applications, prescribed by the secretary of state, to the publicfor military-overseas

1 ballots without any specific request being made for the applications. All other electors must
2 request an application for an absent voter's ballot.
