1 A BILL for an Act to amend and reenact sections 15.1-09-22, 15.1-09-23, and 15.1-09-24 of the
2 North Dakota Century Code, relating to the scheduling of school district elections.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Section 15.1-09-22 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 15.1-09-22. School boards - Annual electionsElections - Poll books.
7 1. The board of a school district shall hold an election each year between April first and
8 June thirtieth to fill all vacancies, including those caused by the expiration of terms of
9 office. A school district with board members who serve four-year terms, as provided
10 under section 15.1-09-03, shall hold elections only in even-numbered years. In an
11 even-numbered year, a school district election must be held in conjunction with the
12 primary election on the second Tuesday in June. In an odd-numbered year, a school
13 district election must be held between April first and June thirtieth.
14 2. Upon resolution of the school board, the annual election may be held in conjunction
15 with the regular election of a city, as required by state law or by the home rule powers
16 of the city, provided the city is located wholly or partially within the school district. The
17 school board may agree with the governing body of the city to share election costs and
18 responsibilities, including those associated with election personnel, the printing of
19 election materials, the publishing of legal notices, and the use of poll books.
20 3. If a school board holds its election in conjunction with a city, references in this chapter
21 to the date of a school board election mean the date of the applicable city election.

1 4. If a school board holds its election in conjunction with a city and only one set of poll
2 books is used, the set must reference the voter's eligibility to vote in the city election,
3 in the school district election, or both.
4 SECTION 2. AMENDMENT. Section 15.1-09-23 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 15.1-09-23. School boards - Special elections.
7 In addition to the annual electionor biennial elections, a special election may be held at any
8 time and for any lawful purpose, if approved by the school board.
9 SECTION 3. AMENDMENT. Section 15.1-09-24 of the North Dakota Century Code is
10 amended and reenacted as follows:
11 15.1-09-24. School boards - Sharing of election expenses.
12 IfWhen a school district election is held in conjunction with a primary election, the board of
13 the school district may agree with the governing body of the county or counties in which the
14 district is located to share election costs and responsibilities, including those associated with a
15 canvassing board, election personnel, the printing of election materials, the publishing of legal
16 notices, and the use of poll books. Each board of a school district that enters into an agreement
17 with the county must notify the county auditor, in writing, at least sixty-four days before the
18 election of the offices to be filled at the election and any measures to appear on the ballot.
