1 A BILL for an Act to amend and reenact sections 15.1-21-02.4 and 15.1-21-02.5 of the North
2 Dakota Century Code, relating to eligibility for the North Dakota career and technical education
3 scholarship and the North Dakota academic scholarship for high school students enrolled in
4 school districts using course proficiency-based grading systems.
5 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
6 SECTION 1. AMENDMENT. Section 15.1-21-02.4 of the North Dakota Century Code is
7 amended and reenacted as follows:
8 15.1-21-02.4. North Dakota career and technical education scholarship. (Effective
9 through July 31, 2021)
10 Any resident student who graduates from a high school during or after the 2010-11 school
11 year and any resident student who completes a program of home education supervised in
12 accordance with chapter 15.1-23 during or after the 2012-13 school year is eligible to receive a
13 North Dakota career and technical education scholarship provided the student:
14 1. Completed four units of English language arts from a sequence that includes literature,
15 composition, and speech;
16 2. Completed three units of mathematics, including:
17 a. One unit of algebra II, as defined by the superintendent of public instruction; and
18 b. Two units of any other mathematics, which may include one unit of computer
19 science;
20 3. Completed three units of science, consisting of:
21 a. (1) One unit of biology;
22 (2) One unit of chemistry; and
23 (3) One unit of physics; or
24 b. (1) One unit of biology;

1 (2) One unit of physical science; and
2 (3) One unit or two one-half units of any other science;
3 4. Completed three units of social studies, including:
4 a. One unit of United States history;
5 b. (1) One-half unit of United States government and one-half unit of economics;
6 or
7 (2) One unit of problems of democracy; and
8 c. One unit or two one-half units of any other social studies, which may include
9 civics, civilization, geography and history, multicultural studies, North Dakota
10 studies, psychology, sociology, and world history;
11 5. a. Completed one unit of physical education; or
12 b. One-half unit of physical education and one-half unit of health;
13 6. Completed:
14 a. One unit selected from:
15 (1) Foreign languages;
16 (2) Native American languages;
17 (3) American sign language;
18 (4) Fine arts; or
19 (5) Career and technical education courses; and
20 b. Two units of a coordinated plan of study recommended by the department of
21 career and technical education and approved by the superintendent of public
22 instruction or an education pathway approved by the superintendent of public
23 instruction. The education pathway must consist of two units in teaching
24 profession and educational methodology and at least one additional unit in
25 advanced placement or dual-credit psychology, child development, peer-to-peer
26 leadership, or child-related careers;
27 7. Completed any five additional units, two of which must be in the area of career and
28 technical education;
29 8. a. (1) Obtained a cumulative grade point average of at least 3.0 on a 4.0 grading
30 scale, as determined by the superintendent of public instruction, based on
31 all high school units in which the student was enrolled; and

1 (2) Obtained a grade of at least "C" in each unit or one-half unit; or
2 b. (1) Obtained a cumulative grade point average of at least 3.0 on a 4.0 grading
3 scale, as determined by the superintendent of public instruction, based only
4 on the units required by subsections 1 through 7; and
5 (2) Obtained a grade of at least "C" in each unit or one-half unit; and
6 9. Received:
7 a. A composite score of at least twenty-four on an ACT; or
8 b. A score of at least five on each of three WorkKeys assessments recommended
9 by the department of career and technical education and approved by the
10 superintendent of public instruction.
11 North Dakota career and technical education scholarship. (Effective after July 31,
12 2021)
13 Any resident student who graduates from a high school during or after the 2010-11 school
14 year and any resident student who completes a program of home education supervised in
15 accordance with chapter 15.1-23 during or after the 2012-13 school year is eligible to receive a
16 North Dakota career and technical education scholarship provided the student:
17 1. Completed four units of English language arts from a sequence that includes literature,
18 composition, and speech;
19 2. Completed three units of mathematics, including:
20 a. One unit of algebra II, as defined by the superintendent of public instruction; and
21 b. Two units of any other mathematics, which may include one unit of computer

2 or
3 (2) One unit of problems of democracy; and
4 c. One unit or two one-half units of any other social studies, which may include
5 civics, civilization, geography and history, multicultural studies, North Dakota
6 studies, psychology, sociology, and world history;
7 5. a. Completed one unit of physical education; or
8 b. One-half unit of physical education and one-half unit of health;
9 6. Completed:
10 a. One unit selected from:
11 (1) Foreign languages;
12 (2) Native American languages;
13 (3) American sign language;
14 (4) Fine arts; or
15 (5) Career and technical education courses; and
16 b. Two units of a coordinated plan of study recommended by the department of
17 career and technical education and approved by the superintendent of public
18 instruction or an education pathway approved by the superintendent of public
19 instruction which may be governed by rules adopted by the superintendent of
20 public instruction;
21 7. Completed any five additional units, two of which must be in the area of career and
22 technical education;
23 8. a. (1) Obtained a cumulative grade point average of at least 3.0 on a 4.0 grading
24 scale, or an equivalent course proficiency score if the student was enrolled
25 in a school district participating in an approved innovative education
26 program under section 15.1-06-08.2 and the school district obtained a
27 waiver under section 15.1-06-08.1, as determined by the superintendent of
28 public instruction, based on all high school units in which the student was
29 enrolled; and
30 (2) Obtained a grade of at least "C", or an equivalent course proficiency score,
31 in each unit or one-half unit; or

1 b. (1) Obtained a cumulative grade point average of at least 3.0 on a 4.0 grading
2 scale, or an equivalent course proficiency score if the student was enrolled
3 in a school district participating in an approved innovative education
4 program under section 15.1-06-08.2 and the school district obtained a
5 waiver under section 15.1-06-08.1, as determined by the superintendent of
6 public instruction, based only on the units required by subsections 1 through
7 7; and
8 (2) Obtained a grade of at least "C", or an equivalent course proficiency score,
9 in each unit or one-half unit; and
10 9. Received:
11 a. A composite score of at least twenty-four on an ACT; or
12 b. A score of at least five on each of three WorkKeys assessments recommended
13 by the department of career and technical education and approved by the
14 superintendent of public instruction.
15 SECTION 2. AMENDMENT. Section 15.1-21-02.5 of the North Dakota Century Code is
16 amended and reenacted as follows:
17 15.1-21-02.5. North Dakota academic scholarship.
18 Any resident student who graduates from a high school during or after the 2010-11 school
19 year and any resident student who completes a program of home education supervised in
20 accordance with chapter 15.1-23 during or after the 2012-13 school year is eligible to receive a
21 North Dakota academic scholarship provided the student:
22 1. Completed four units of English language arts from a sequence that includes literature,
23 composition, and speech;
24 2. Completed three units of mathematics, including:
25 a. One unit of algebra II, as defined by the superintendent of public instruction;
26 b. One unit of mathematics for which algebra II, as defined by the superintendent of
27 public instruction, is a prerequisite; and
28 c. One unit of any other mathematics, which may include computer science;
29 3. Completed three units of science, consisting of:
30 a. (1) One unit of biology;
31 (2) One unit of chemistry; and

1 (3) One unit of physics; or
2 b. (1) One unit of biology;
3 (2) One unit of physical science; and
4 (3) One unit or two one-half units of any other science;
5 4. Completed three units of social studies, including:
6 a. One unit of United States history;
7 b. (1) One-half unit of United States government and one-half unit of economics;
8 or
9 (2) One unit of problems of democracy; and
10 c. One unit or two one-half units of any other social studies, which may include
11 civics, civilization, geography and history, multicultural studies, North Dakota
12 studies, psychology, sociology, and world history;
13 5. a. Completed one unit of physical education; or
14 b. One-half unit of physical education and one-half unit of health;
15 6. a. Completed two units of:
16 (1) The same foreign language;
17 (2) The same native American language;
18 (3) American sign language; or
19 (4) Career and technical education from a coordinated plan of study
20 recommended by the department of career and technical education and
21 approved by the superintendent of public instruction or an education
22 pathway, approved by the superintendent of public instruction. The
23 education pathway must consist of two units in teaching profession and
24 educational methodology and at least one additional unit in advanced
25 placement or dual-credit psychology, child development, peer-to-peer
26 leadership, or child-related careers; and
27 b. One unit selected from:
28 (1) Foreign languages;
29 (2) Native American languages;
30 (3) American sign language;
31 (4) Fine arts; or

1 (5) Career and technical education;
2 7. Completed any five additional units;
3 8. a. (1) Obtained a cumulative grade point average of at least 3.0 on a 4.0 grading
4 scale, or an equivalent course proficiency score if the student was enrolled
5 in a school district participating in an approved innovative education
6 program under section 15.1-06-08.2 and the school district obtained a
7 waiver under section 15.1-06-08.1, as determined by the superintendent of
8 public instruction, based on all high school units in which the student was
9 enrolled; and
10 (2) Obtained a grade of at least "C", or an equivalent course proficiency score,
11 in each unit or one-half unit; or
12 b. (1) Obtained a cumulative grade point average of at least 3.0 on a 4.0 grading
13 scale, or an equivalent course proficiency score if the student was enrolled
14 in a school district participating in an approved innovative education
15 program under section 15.1-06-08.2 and the school district obtained a
16 waiver under section 15.1-06-08.1, as determined by the superintendent of
17 public instruction, based only on the units required by subsections 1 through
18 7; and
19 (2) Obtained a grade of at least "C", or an equivalent course proficiency score,
20 in each unit or one-half unit;
21 9. Received a composite score of at least twenty-four on an ACT; and
22 10. a. Fulfilled any one unit requirement set forth in subsections 1 through 7 by means
23 of an advanced placement course and examination;
24 b. Fulfilled any one unit requirement set forth in subsections 1 through 4 or 6 by
25 completion, through an early entrance program, of a nonremedial postsecondary
26 course offered for credit at an accredited institution of higher education which has
27 a physical presence in this state; or
28 c. Fulfilled any one-half unit requirement set forth in subsections 1 through 7 by
29 means of a dual-credit course.
