1 A BILL for an Act to amend and reenact section 12-59-08 of the North Dakota Century Code,
2 relating to medical paroles.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Section 12-59-08 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 12-59-08. Medical paroles.
7 If an inmate, including an inmate whose sentence is subject to sections 12.1-32-02.1 and
8 12.1-32-09.1, and an inmate sentenced under subsection 1 of section 12.1-32-01, has a serious
9 or terminal medical condition or has a substantial risk of developing a serious or terminal
10 medical condition based on underlying medical conditions, the parole board may grant the
11 inmate a medical parole. An inmate who receives a medical parole remains under the
12 jurisdiction of the parole board until the expiration of the maximum term or terms of
13 imprisonment for which the inmate was sentenced, less any sentence reduction the inmate has
14 received.
