1 A BILL for an Act to amend and reenact subsection 2 of section 27-20-24, subsections 2 and 3
2 of section 27-20-30.1 and subsection 1 of section 27-20-45 of the North Dakota Century Code,
3 relating to juvenile court.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. AMENDMENT. Subsection 2 of section 27-20-24 of the North Dakota Century
6 Code is amended and reenacted as follows:
7 2. If the hearing has not been held within the time limit, or any extension thereof, required
8 by subsection 1 of section 27-20-22rule 2 of the North Dakota Rules of Juvenile
9 Procedure, the petition must be dismissed.
10 SECTION 2. AMENDMENT. Subsections 2 and 3 of section 27-20-30.1 of the North Dakota
11 Century Code are amended and reenacted as follows:
12 2. A petition to commence an action under this section must contain information required
13 under section 27-20-21rule 3 of the North Dakota Rules of Juvenile Procedure, along
14 with an affidavit either prepared by the administrative county, as determined by the
15 department of human services, or prepared by an agency or tribal council of a
16 recognized Indian reservation in North Dakota.
17 3. The court shall issue a summons in accordance with section 27-20-22rule 5 of the
18 North Dakota Rules of Juvenile Procedure, upon the filing of a petition and affidavit.
19 SECTION 3. AMENDMENT. Subsection 1 of section 27-20-45 of the North Dakota Century
20 Code is amended and reenacted as follows:
21 1. The petition must comply with section 27-20-21rule 3 of the North Dakota Rules of
22 Civil Procedure, and state clearly that an order for termination of parental rights is
23 requested and that the effect will be as stated in section 27-20-46.
