1 A BILL for an Act to amend and reenact section 15.1-07-20 of the North Dakota Century Code,
2 relating to payments for school bus driver physical examinations.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Section 15.1-07-20 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 15.1-07-20. School vehicle driver - Requirements.
7 1. a. Except as otherwise provided in this subsection, if an individual transports
8 students or other passengers in a school vehicle for which a commercial driver's
9 license is not required, the individual must:
10 (1) Hold a North Dakota driver's license;
11 (2) Be free from communicable diseases;
12 (3) Be in good physical health and have normal use of both hands, both feet,
13 both eyes, and both ears;
14 (4) Be of sound mental health;
15 (5) Pass any drug and alcohol screening tests required by the school board;
16 and
17 (6) Be at least twenty-one years of age, unless the board of a school district
18 determines that an individual not meeting this requirement can safely and
19 adequately perform the required duties.
20 b. If the vehicle being used to transport students or other passengers under this
21 subsection is a school vehicle for which a commercial driver's license is not
22 required, but which is designed to seat ten to fifteen passengers, the individual
23 must:
24 (1) Hold a North Dakota driver's license;

1 (2) Meet the physical and medical requirements established for commercial
2 vehicle drivers;
3 (3) Complete any annual training required by the superintendent of public
4 instruction; and
5 (4) Be at least twenty-one years of age, unless the board of a school district
6 determines that an individual not meeting this requirement can safely and
7 adequately perform the required duties.
8 2. a. The board of a school district may request, at any time, that a health care
9 professional designated by the board examine an individual to determine if the
10 individual meets the physical and medical requirements of subsection 1.
11 b. The health care professional conducting the examination shall forward any
12 charges to the individual's insurance carrier for payment. Any examination costs
13 thatfor an initial examination which remain after application of the individual's
14 insurance coverage are the responsibility of the board. For any additional
15 examinations, unless otherwise provided for by the board, any costs that remain
16 after application of the individual's insurance coverage are the responsibility of
17 the individual.
