1 A BILL for an Act to create and enact a new section to chapter 39-04 of the North Dakota
2 Century Code, relating to registration fees for motor vehicles and a driver's education fund; and
3 to provide a continuing appropriation.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. A new section to chapter 39-04 of the North Dakota Century Code is created
6 and enacted as follows:
7 Additional fee for motor vehicle registration - Disposition of fees - Driver's education
8 fund - Continuing appropriation.
9 1. In addition to any other fees required under this chapter for registration of a motor
10 vehicle, the department shall impose on each motor vehicle registration and
11 subsequent annual renewals a driver's education fee of one dollar.
12 2. The department shall deposit any moneys collected under subsection 1 in a special
13 driver's education fund, which must be administered by the director. Any moneys
14 deposited into the fund must be used for:
15 a. Retaining and recruiting teachers who provide driver's education instruction in
16 public and nonpublic schools in the state;
17 b. Reimbursing expenses incurred by public and nonpublic schools for necessary
18 driver's education curriculum materials, supplies, or equipment; and
19 c. Purchasing equipment necessary for public and nonpublic schools to improve or
20 effectively maintain an efficient driver's education curriculum.
21 3. The director shall adopt rules establishing the qualifications, application procedure,
22 and guidelines for approval of disbursements to public and nonpublic schools pursuant
23 to this section.

1 4. Any moneys deposited in the driver's education fund, including any income derived
2 therefrom, are appropriated on a continuing basis to the department for the purposes
3 listed in subsection 2.
4 5. As used in this section:
5 a. "Motor vehicle" means a passenger motor vehicle or a pickup truck. The term
6 does not include a motorcycle;
7 b. "Nonpublic school" means any school certified as approved under section
8 15.1-06-06.1; and
9 c. "Public school" means any school certified as approved under section
10 15.1-06-06.
