1 A BILL for an Act to create and enact a new section to chapter 15.1-07 of the North Dakota
2 Century Code, relating to a teacher incentives for leadership in education program; and to
3 provide for an exemption.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. A new section to chapter 15.1-07 of the North Dakota Century Code is created
6 and enacted as follows:
7 Teacher incentives for leadership in education - Program - Administration.
8 1. The superintendent of public instruction shall administer a teacher incentives for
9 leadership in education program to provide professional development to teachers or to
10 offer project-based incentives to teachers working on academic initiatives in the school
11 district. The superintendent shall adopt rules to administer the program.
12 2. The teacher incentives for leadership in education program must:
13 a. Calculate the funding available for each district in the state by:
14 (1) Dividing the ten million dollars available for the program by the total number
15 of students enrolled in kindergarten through grade twelve; and
16 (2) Multiplying the dollar amount per student under paragraph 1 by the total
17 number of students enrolled in each school district.
18 b. Allow each eligible school district to use the amount available to provide
19 additional professional development to teachers employed in the district, or offer
20 project-based incentives to teachers employed in the district and who are working
21 on academic initiatives.
22 c. Require school districts to develop and submit to the review committee a
23 comprehensive plan detailing how the district intends to use the available money
24 under the program to benefit teachers employed in the district.

1 d. Establish a committee to review plans submitted by school districts. The review
2 committee must be composed of:
3 (1) The superintendent of public instruction or the superintendent's designee;
4 (2) The governor or the governor's designee; and
5 (3) The chairmen of the house of representatives and senate education
6 standing committees.
7 e. Develop criteria for determining approval of plans submitted by school districts.
8 SECTION 2. EXEMPTION - INTEGRATED FORMULA PAYMENTS - DEPARTMENT OF
9 PUBLIC INSTRUCTION - TEACHER INCENTIVES FOR LEADERSHIP IN EDUCATION. Any
10 amount provided for integrated formula payments which is unexpended as of June 30, 2019, is
11 not subject to section 54-44.1-11 and is available during the biennium beginning July 1, 2019,
12 and ending June 30, 2021. The department of public instruction may use up to ten million
13 dollars of these payments for the creation of a teacher incentives for leadership in education
14 program. The teacher incentives for leadership in education dollars must be invested in teacher
15 professional development or used to provide project-based incentives for currently employed
16 district teachers, providing career track opportunities for teacher leaders.
