1 A BILL for an Act to amend and reenact subsection 3 of section 39-12-02 of the North Dakota
2 Century Code, relating to annual permits for vehicles of excessive size or weight; and to declare
3 an emergency.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. AMENDMENT. Subsection 3 of section 39-12-02 of the North Dakota Century
6 Code is amended and reenacted as follows:
7 3. An appropriate charge must be made for a permit and all funds collected hereunder by
8 the highway patrol must be deposited in the state highway fund for use in the
9 construction and maintenance of highways and operating expenses of the department.
10 Permit fees generated by a political subdivision must be deposited in the local
11 authority's general fund for support of the local road system. Publicly owned vehicles
12 that provide service beyond the agency's jurisdiction, official, publicly owned,
13 emergency, or military vehicles are not subject to charges for permits. The minimum
14 fee for selected charges is as follows:
15 a. The fee for the ten percent weight exemption, harvest and wintertime, is fifty
16 dollars per month for fees paid on a monthly basis or two hundred fifty dollars per
17 year for fees paid on a yearly basis. Unused fees paid on a monthly basis are
18 refundable. Unused fees paid on a yearly basis are not refundable.
19 b. The fee for an interstate permit is ten dollars per trip or three hundred dollars per
20 calendar year for unlimited trips.
21 c. The fee for special mobile equipment is twenty-five dollars per trip.
22 d. The fee for engineering is twenty-five dollars per trip.
23 e. The fee for faxing a permit is five dollars.
24 f. The fee for a single trip permit is twenty dollars per trip.

1 g. The fee for a bridge length permit is thirty dollars per trip or one hundred fifty
2 dollars per calendar yeartwelve-month period.
3 h. The fee for a longer combination vehicle permit is one hundred dollars per month
4 for fees paid on a monthly basis.
5 i. The fee for an overwidth vehicle or load that is fourteen feet six inches
6 [4.42 meters] or less is twenty dollars per trip or one hundred fifty dollars per
7 calendar yeartwelve-month period unless the vehicle is a noncommercial
8 fishhouse trailer being moved by the owner, then the fee is twenty dollars per
9 calendar yeartwelve-month period.
10 j. The fee for an overlength vehicle or load that is one hundred twenty feet [36.58
11 meters] or less is twenty dollars per trip or one hundred fifty dollars per calendar
12 yeartwelve-month period.
13 k. The highway patrol may establish an online electronic permit system. If the
14 highway patrol establishes an online electronic permit system, the highway patrol
15 shall assess an additional fee of up to fifteen dollars for every permit issued
16 under this section to be deposited into the motor carrier electronic permit
17 transaction fund.
18 SECTION 2. EMERGENCY. This Act is declared to be an emergency measure.
