1 A BILL for an Act to amend and reenact section 54-59-20 of the North Dakota Century Code,
2 relating to criminal history background checks for contract employees of the information
3 technology department.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. AMENDMENT. Section 54-59-20 of the North Dakota Century Code is
6 amended and reenacted as follows:
7 54-59-20. Security background information.
8 The chief information officer shall require as a condition of employment or as a condition of
9 contracting with the department that individuals, including any individuals employed by the
10 contractor or a subcontractor to perform work under the contract, who have unescorted physical
11 access to the facilities or other security-sensitive areas of the department designated by the
12 chief information officer submit to a criminal history record check in accordance with section
13 12-60-24. The chief information officer may require as a condition of contracting with the
14 department or other state agency or department with respect to an information technology
15 project that any individual employed by the contractor or a subcontractor to perform the work
16 under the contract submit to a criminal history record check in accordance with section
17 12-60-24.
