1 A BILL for an Act to amend and reenact section 43-15-31.4 of the North Dakota Century Code,
2 relating to pharmacists limited prescriptive practices.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Section 43-15-31.4 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 43-15-31.4. Limited prescriptive practices.
7 1. A pharmacist has limited prescriptive practices to initiate or modify drug therapy
8 following diagnosis or established protocols by a licensed physician or an advanced
9 practice registered nurse, under the supervision of the licensed physician or advanced
10 practice registered nurse, in accordance with this section. The licensed physician or
11 the, advanced practice registered nurse, and the pharmacist must have access to the
12 patient's appropriate medical records. The care provided to the patient by the
13 pharmacist must be recorded in the patient's medical records and communicated to
14 the licensed physician or the advanced practice registered nurse.
15 2. The licensed physician or the advanced practice registered nurse, and the pharmacist,
16 shall prepare a collaborative agreement concerning the scope of the pharmacist's
17 prescriptive practices and shall update the agreement at least every four years or
18 when they modifyif the scope of the pharmacist's prescriptive practices is modified.
19 The collaborative agreement, or an amendment to the agreement, is effective when
20 approved by the North Dakota board of medicine or board of nursing and the board of
21 pharmacyif executed by the licensed physician or advanced practice registered nurse,
22 and the pharmacist.
23 3. The collaborative agreement may be between a medical director and
24 pharmacist-in-charge. The medical director and pharmacist-in-charge shall report to

1 the respective board ofdocument and update the agreement for any physician,
2 advanced practice registered nurse, and pharmacist covered under the agreement.
3 4. If there is a change in personnel under the collaborative agreement, a pharmacist,
4 physician, and advanced practice registered nurse under the collaborative agreement
5 shall send immediate notice of the change to the respective licensing board of that
6 individual. Unless necessary, a change in personnel does not necessitate board
7 approval of the collaborative agreementA collaborative agreement must be made
8 available to the respective licensing boards of the parties to the agreement.
9 5. The collaborative agreement must include a provision that requires the pharmacist to
10 immediately notify the licensed physician or advanced practice registered nurse whenif
11 the pharmacist initiates or modifies a drug therapy.
12 6. Any rules to implement this section must be jointly adopted by the board of medicine
13 or the board of nursing and the board of pharmacy.
