1    A BILL for an Act to create and enact a new subsection to section 62.1-02-10 of the North
2    Dakota Century Code, relating to possession of a loaded firearm in a vehicle; to amend and
3    reenact subdivision l of subsection 2 of section 62.1-02-05 and subsection 4 of section
4    62.1-02-05 of the North Dakota Century Code, relating to possessing a firearm or dangerous
5    weapon in a church; to provide a penalty; and to declare an emergency.
6    BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
7        SECTION 1. AMENDMENT. Subdivision l of subsection 2 of section 62.1-02-05 of the North
8    Dakota Century Code is amended and reenacted as follows:
9              l.    An individual possessing a valid concealed weapons license from this state or
10                   who has reciprocity under section 62.1-04-03.1 authorizing the individual to carry
11                   a firearm or dangerous weapon concealed if the individual is in a church building
12                   or other place of worship and has the approval to carry in the church building or
13                   other place of worship by a primary religious leader of the church or other place
14                   of worship or the governing body of the church or other place of worship;
15       SECTION 2. AMENDMENT. Subsection 4 of section 62.1-02-05 of the North Dakota
16   Century Code is amended and reenacted as follows:
17       4.   Notwithstanding any other provision of law, a church or place of worship may not be
18            held liable for any injury or death or damage to property caused by an individual
19            permitted to carry a firearm or dangerous weapon concealed under this section.
20       SECTION 3. A new subsection to section 62.1-02-10 of the North Dakota Century Code is
21   created and enacted as follows:
22            An individual who is not otherwise precluded from possessing a class 2 firearm and
23            dangerous weapon license under chapter 62.1-04 and has possessed for at least one

1           year a valid driver's license or nondriver identification card issued by the department of
2           transportation.
3      SECTION 4. EMERGENCY. This Act is declared to be an emergency measure.
