1 A BILL for an Act to amend and reenact section 39-06-05 of the North Dakota Century Code,
2 relating to the age of students enrolled in a driver's training course.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Section 39-06-05 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 39-06-05. Restricted instruction permit - When instruction permit not required -
7 Driver's training course.
8 1. The director upon receiving proper application may issue a restricted instruction permit
9 effective for a school year or more restricted period to an applicant who is at least
10 fourteen years of age and enrolled in a commercial driver training course that includes
11 practice driving and which is approved by the director of the highway patrol under
12 chapter 39-25. The restricted instruction permit entitles the permittee when the
13 permittee has the permit in the permittee's immediate possession to operate a motor
14 vehicle with an approved instructor occupying a seat beside the permittee and on a
15 designated highway or within a designated area.

17 a. Subject to subdivision b, any student who is at least fourteen years of age and
18 enrolled in behind-the-wheel driver's training through a high school program
19 approved by the superintendent of public instruction may operate a motor
20 vehicle, under the supervision of a driver training instructor certified by the
21 superintendent of public instruction, without a permit or license to operate a
22 motor vehicle, if the school district sponsoring the driver's training program has
23 an insurance policy covering any damage that may be done by a student while
24 operating the vehicle and proof of coverage is filed with the superintendent of

1 public instruction by the school district's insurance carrier. The insurance
2 coverage must be in the amount required under section 39-16.1-02to establish
3 proof of financial responsibility.
4 b. A student may not enroll in a driver's training course through a high school
5 program approved by the superintendent of public instruction unless the student
6 will be at least fourteen years of age by the completion date of the classroom
7 portion of the driver's training course. A student may not participate in the
8 behind-the-wheel driver's training portion of the driver's training course until the
9 student is at least fourteen years of age. A student must complete the driver's
10 training course's required amount of behind-the-wheel driver's training before
11 successfully completing the course.
