1 A BILL for an Act to create and enact a new section to chapter 62.1-01 of the North Dakota
2 Century Code, relating to a restriction on firearm buyback programs; and to provide a penalty.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. A new section to chapter 62.1-01 of the North Dakota Century Code is created
5 and enacted as follows:
6 Firearm buyback program - Prohibited.
7 1. As used in this section, "firearm buyback program" means a program to purchase
8 privately owned firearms, firearm parts, or ammunition from private individuals or
9 organizations for the purpose of providing cash, gifts, or vouchers; or reducing the
10 number of firearms, firearm parts, or ammunition owned by civilians; or permitting a
11 civilian to sell a firearm to the government without fear of prosecution. The term does
12 not include the purchase of firearms, firearm parts, or ammunition from a licensed
13 firearms dealer, or a program to purchase firearms, firearm parts, or ammunition for
14 law enforcement purposes.
15 2. A state agency, political subdivision, or any law enforcement agency of this state may
16 not conduct a firearm buyback program or participate in the implementation,
17 administration, or operation of a firearm buyback program.
18 3. A state agency, political subdivision, or any law enforcement agency of this state may
19 not expend any taxpayer dollars for the purpose of implementing, administering, or
20 otherwise operating a firearm buyback program.
21 4. A violation of this section is a class A misdemeanor.
