1 A BILL for an Act to amend and reenact subsection 1 of section 39-08-09 of the North Dakota
2 Century Code, relating to the immediate notice of a vehicle accident.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Subsection 1 of section 39-08-09 of the North Dakota Century
5 Code is amended and reenacted as follows:
6 1. The driver of a vehicle involved in an accident resulting in injury to or death of any
7 personindividual, or property damage to an apparent extent of at least onethree
8 thousand dollars, shall immediately give notice of the accident to the local police
9 department if the accident occurs within a municipality, otherwise to the office of the
10 county sheriff or the state highway patrol. Any personA driver who violates this section
11 must be assessed a fine of fifty dollars. The name of the motor vehicle insurance
12 policy carrier and the policy number of the driver, or if the driver is not the owner of the
13 vehicle, then the motor vehicle insurance policy carrier and the policy number of the
14 owner of the vehicle, must be furnished to the law enforcement officer investigating the
15 accident. If the driver does not have the required information concerning insurance to
16 furnish to the investigating law enforcement officer, then within five days of the
17 accident the driver shall supply that information to the driver's license division in the
18 form the division requires.
