1 A BILL for an Act to amend and reenact section 16.1-16-09 of the North Dakota Century Code,
2 relating to appeals of election contest judgments.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Section 16.1-16-09 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 16.1-16-09. Appeal of election contest judgment.
7 An appeal to the supreme court of the judgment in an election contest action may be had by
8 filing a notice of appeal with the clerk of the trialsupreme court within ten days of the date of the
9 service of notice of entry of the judgment. Appeals of election contest actions must be
10 conducted in the manner provided by the North Dakota Rules of Appellate Procedure. Election
11 contest appeals must take precedence over regular court business so election results can be
12 determined as soon as practicable. An appeal may be brought on for hearing before the
13 supreme court at any time upon ten days' notice by either party and must be determined in a
14 summary manner.
