1 A BILL for an Act to create and enact a new section to chapter 20.1-01 of the North Dakota
2 Century Code, relating to hunting predators; and to amend and reenact section 20.1-01-08 of
3 the North Dakota Century Code, relating to hunting predators at night with artificial light, digital
4 night vision, thermal vision, or infrared light.
5 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
6 SECTION 1. AMENDMENT. Section 20.1-01-08 of the North Dakota Century Code is
7 amended and reenacted as follows:
8 20.1-01-08. Hunting with artificial light prohibited - Exception.
9 It is unlawful for an individual to pursue, shoot, kill, take or attempt to take any wildlife
10 between sunset of one day and sunrise of the next, with the aid of a spotlight or any other
11 artificial light. This section does not make it unlawful for an individual to use a lantern, spotlight,
12 digital night vision, thermal vision, infrared light, or other artificial light to assist the
13 personindividual or another individual in pursuing and shooting on the person'seither individual's
14 premises any coyote, fox, skunk, mink, raccoon, beaver, weasel, owl, rabbit, or other predatory
15 animal or bird, attacking and attempting to destroy the person's poultry, livestock, or other
16 property. It is permissible to use an artificial light with a power source of not more than six volts
17 while hunting afoot for raccoon or beaver during the open season on the animal. A red or amber
18 filter must be placed on any artificial light used in the hunting of raccoon or beaver, except when
19 taking a raccoon treed or at bay.
20 SECTION 2. A new section to chapter 20.1-01 of the North Dakota Century Code is created
21 and enacted as follows:
22 Hunting predators.
23 Notwithstanding section 20.1-08-04.7, an individual with or without a license may pursue
24 and shoot on the individual's premises any coyote, fox, skunk, mink, raccoon, weasel, or other

1 predatory animal at any time after the end of the last day of the regular deer hunting season
2 established by the governor's order or proclamation and before the following August thirty-first.
3 An individual authorized to pursue and shoot a predatory animal under this section may be
4 assisted by another individual, and the assistant may pursue and shoot a predatory animal on
5 the same premises and during the same time as the authorized individual.
