1 A BILL for an Act to amend and reenact section 15.1-07-20 of the North Dakota Century Code,
2 relating to mandatory safety training for school bus drivers.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Section 15.1-07-20 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 15.1-07-20. School vehicle driver - Requirements.
7 1. a. Except as otherwise provided in this subsection, if an individual transports
8 students or other passengers in a school vehicle for which a commercial driver's
9 license is not required, the individual must:
10 (1) Hold a North Dakota driver's license;
11 (2) Be free from communicable diseases;
12 (3) Be in good physical health and have normal use of both hands, both feet,
13 both eyes, and both ears;
14 (4) Be of sound mental health;
15 (5) Pass any drug and alcohol screening tests required by the school board;
16 and
17 (6) Be at least twenty-one years of age, unless the board of a school district
18 determines that an individual not meeting this requirement can safely and
19 adequately perform the required duties; and
20 (7) Complete the national safety council defensive driving course number four
21 workshop within the first year of employment and at least once every five
22 years thereafter.
23 b. If the vehicle being used to transport students or other passengers under this
24 subsection is a school vehicle for which a commercial driver's license is not

1 required, but which is designed to seat ten to fifteen passengers, the individual
2 must:
3 (1) Hold a North Dakota driver's license;
4 (2) Meet the physical and medical requirements established for commercial
5 vehicle drivers;
6 (3) Complete any annual training required by the superintendent of public
7 instruction; and
8 (4) Be at least twenty-one years of age, unless the board of a school district
9 determines that an individual not meeting this requirement can safely and
10 adequately perform the required duties; and
11 (5) Complete the national safety council defensive driving course number four
12 workshop within the first year of employment and at least once every five
13 years thereafter.
14 2. a. The board of a school district may request, at any time, that a health care
15 professional designated by the board examine an individual to determine if the
16 individual meets the physical and medical requirements of subsection 1.
17 b. The health care professional conducting the examination shall forward any
18 charges to the individual's insurance carrier for payment. Any examination costs
19 that remain after application of the individual's insurance coverage are the
20 responsibility of the board.
