1 A BILL for an Act to amend and reenact section 29-26-22.2 of the North Dakota Century Code,
2 relating to the authority of the county commission to compromise and settle debt obligations.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. AMENDMENT. Section 29-26-22.2 of the North Dakota Century Code is
5 amended and reenacted as follows:
6 29-26-22.2. Authority to compromise judgment by county commissioners.
7 The
8 1. If, after a lapse of two years from the filing of a judgment, the board of county
9 commissioners determines the judgment cannot be collected in full, the board of
10 county commissioners has authority tomay compromise and settle any judgment for
11 fines or costs arising from criminal proceedings which are payable to the county
12 treasury after a lapse of two years from the filing thereof, if in the opinion of said board
13 said judgment cannot be collected in fullstate treasurer.
14 2. The county's compromise or settlement may include a request to the district court to
15 convert any amount still owed to a civil judgment.
16 3. Upon receipt of a certified copy of the board's action, the state's attorney of saidthe
17 county where the judgment was filed shall in accordance therewith make and file a
18 partial or total satisfaction of saidthe judgment as attorney for the county.
19 4. Upon a compromise or settlement, the county may contract with a private debt
20 collection company to collect any remaining balance. The county shall deposit any
21 additional revenue collected under this subsection in the county general fund.
