1 A BILL for an Act to create and enact section 43-19.1-16.2 of the North Dakota Century Code,
2 relating to qualifications of land surveyor interns; to amend and reenact sections 43-19.1-16 and
3 43-19.1-16.1 of the North Dakota Century Code, relating to regulation of land surveyors and
4 land surveyor interns; to repeal section 43-19.1-16.1 of the North Dakota Century Code, relating
5 to qualifications of land surveyor interns; and to provide an effective date.
6 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
7 SECTION 1. AMENDMENT. Section 43-19.1-16 of the North Dakota Century Code is
8 amended and reenacted as follows:
9 43-19.1-16. Registration - Professional land surveyor.
10 AnyAn individual who shows, to the satisfaction of the board, that the individual is otherwise
11 qualified and is over the age of eighteen years is eligible for registration as a professional land
12 surveyor, if the individual has passed a board-approved examination regarding state laws and
13 rules or other surveying issues specific to the state and:
14 1. Holds a certificate of registration to engage in the practice of land surveying issued on
15 the basis of a minimum sixteen-hour written examination by proper authority of a state,
16 territory, possession of the United States, the District of Columbia, or any foreign
17 country, based on requirements and qualifications as shown by the individual's
18 application which, in the opinion of the board, are equal to or higher than the
19 requirements of this chapter;
20 2. HasHolds a baccalaureate degree in engineering or surveying from an institution that
21 offers accredited programs approved by the board, followed by at least four years
22 ofcertificate as a land surveying experience of a character satisfactory tosurveyor
23 intern issued by the board, who has passed a written examination of at least sixteen
24 hours designed to show that the individual is qualified to practice land surveying; and:

1 a. In addition to experience that may be required to qualify for certification as a land
2 surveyor intern, completed at least four years of land surveying experience of a
3 character satisfactory to the board; and
4 b. Passed a board-approved written examination in the principles and practice of
5 land surveying; or
6 3. Has at least eight years of active experience in land surveying of a character
7 satisfactory to the board, and who has passed a written examination of at least sixteen
8 hours designed to show that the individual is qualified to practice land surveying; or
9 4. Is registered as a land surveyor by the state of North Dakota, under the provisions of
10 former chapter 43-24, on the thirtieth day of June 1967.
11 SECTION 2. AMENDMENT. Section 43-19.1-16.1 of the North Dakota Century Code is
12 amended and reenacted as follows:
13 43-19.1-16.1. Qualifications of land surveyor interns.
14 1. Before July 1, 2028, an applicant for certification as a land surveyor intern may qualify
15 for certification by meeting the requirements of this section or section 43-19.1-16.2.
16 After June 30, 2028, a qualified applicant for certification as a land surveyor intern
17 must meet the requirements of section 43-19.1-16.2.
18 2. An applicant for certification as a land surveyor intern who has at least four years of
19 qualifying land surveying experience of a character satisfactory to the board, of which
20 a formal education in an accredited engineering or land surveying curriculum may
21 constitute a part thereof, may receive from the board, upon passing a written
22 examination on the fundamentals of mathematics and the basic principles of land
23 surveying, a certificate stating that the applicant has passed the examination and been
24 recorded as a land surveyor intern.
25 SECTION 3. Section 43-19.1-16.2 of the North Dakota Century Code is created and
26 enacted as follows:
27 43-19.1-16.2. Qualifications of land surveyor interns.
28 The board shall certify as a land surveyor intern an otherwise qualified applicant who has
29 passed a board-approved written examination on the fundamentals of mathematics and the
30 basic principles of land surveying and:

1 1. Has a baccalaureate degree in land surveying from an institution that offers board-
2 approved accredited programs;
3 2. Has a baccalaureate degree in a board-approved program other than land surveying
4 and:
5 a. Has board-approved educational training in land surveying in connection with the
6 baccalaureate degree or other program; and
7 b. Has at least two years of qualifying land surveying experience of a character
8 satisfactory to the board;
9 3. Has an associate degree in land surveying from a board-approved program and has at
10 least two years of qualifying land surveying experience of a character satisfactory to
11 the board; or
12 4. Has a certificate in land surveying from an institution that offers a board-approved
13 program and has at least four years of qualifying land surveying experience of a
14 character satisfactory to the board.
15 SECTION 4. REPEAL. Section 43-19.1-16.1 of the North Dakota Century Code is repealed.
16 SECTION 5. EFFECTIVE DATE. Section 4 of this Act becomes effective July 1, 2028.
