1 A BILL for an Act to provide an appropriation for defraying the expenses of the judicial branch;
2 and to provide for a transfer.
3 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
4 SECTION 1. APPROPRIATION. The funds provided in this section, or so much of the funds
5 as may be necessary, are appropriated out of any moneys in the general fund in the state
6 treasury, not otherwise appropriated, and from special funds derived from federal funds and
7 other income, to the judicial branch for the purpose of defraying the expenses of the judicial
8 branch for the biennium beginning July 1, 2019, and ending June 30, 2021, as follows:

25 SECTION 2. ONE-TIME FUNDING. The following amounts reflect one-time funding items
26 approved by the sixty-fifth legislative assembly for the 2017-19 biennium:

1 SECTION 3. APPROPRIATION. There are appropriated any funds received by the
2 supreme court, district courts, and judicial conduct commission and disciplinary board, not
3 otherwise appropriated, pursuant to federal acts and private gifts, grants, and donations for the
4 purpose as designated in the federal acts or private gifts, grants, and donations for the period
5 beginning July 1, 2019, and ending June 30, 2021.
6 SECTION 4. TRANSFERS. The director of the office of management and budget shall
7 transfer appropriation authority between line items in section 1 of this Act as requested by the
8 supreme court upon a finding by the court that the nature of the duties of the court and its staff
9 requires the transfers to carry on properly the functions of the judicial branch of government.
10 SECTION 5. UNIVERSITY OF NORTH DAKOTA CENTRAL LEGAL RESEARCH -
11 MATCHING FUND REQUIREMENT. Subdivision 2 of section 1 of this Act includes $40,000
12 from the general fund for university of North Dakota central legal research, which may not be
13 spent until the chief justice of the supreme court certifies to the office of management and
14 budget that $40,000 in matching funds from nonstate sources have been provided to the
15 university of North Dakota for central legal research.
