1 A BILL for an Act to amend and reenact subsection 7 of section 53-06.1-01 and sections
2 53-06.1-08 and 53-06.1-08.2 of the North Dakota Century Code, relating to pull tabs and
3 electronic pull tab devices.
4 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
5 SECTION 1. AMENDMENT. Subsection 7 of section 53-06.1-01 of the North Dakota
6 Century Code is amended and reenacted as follows:
7 7. "Electronic pull tab device" means a device, approved by the attorney general, which
8 electronically displays pull tabs. The term includes a hand-held, portable electronic
9 device.
10 SECTION 2. AMENDMENT. Section 53-06.1-08 of the North Dakota Century Code is
11 amended and reenacted as follows:
12 53-06.1-08. Punchboards and pull tabs.
13 Unless all top tier winning pull tabs or punchboard punches of a game have been
14 redeemed, or unless otherwise permitted by a gaming rule or the attorney general, a person or
15 organization may not close the game after it has been placed in play. The maximum sales price
16 per pull tab and punchboard punch is two dollars. The maximum sales price per pull tab is five
17 dollars. The maximum prize value of a top tier winning pull tab or punchboard punch is five
18 hundred dollars. The game of pull tabs may only be conducted by commingling deals.
19 SECTION 3. AMENDMENT. Section 53-06.1-08.2 of the North Dakota Century Code is
20 amended and reenacted as follows:
21 53-06.1-08.2. Electronic pull tab device requirements.
22 An electronic pull tab device must display an electronic pull tab in which the player may win
23 credits that can be redeemed for cash or used to purchase more pull tabs. The device may not

1 directly dispense coins, cash, tokens, or anything else of value other than a credit ticket
2 voucher.
