1 A BILL for an Act to create and enact a new section to chapter 54-60 of the North Dakota
2 Century Code, relating to the apprenticeship training program; and to amend and reenact
3 sections 54-60-17 and 54-60-17.1 of the North Dakota Century Code, relating to
4 apprenticeships and uses of the internship fund.
5 BE IT ENACTED BY THE LEGISLATIVE ASSEMBLY OF NORTH DAKOTA:
6 SECTION 1. AMENDMENT. Section 54-60-17 of the North Dakota Century Code is
7 amended and reenacted as follows:
8 54-60-17. Division of workforce development - Internships, apprenticeships, and work
9 experience opportunities.
10 1. The division of workforce development shall administer a program to increase use of
11 internships, apprenticeships, and work experience opportunities for higher education
12 students, high school students enrolled in grade eleven or twelve, and educators. The
13 primary focus of this program must be higher education internships in target industries
14 and the apprenticeship training programs under section 3 of this Act.
15 2. This program shallmust provide services to employers, communities, and business
16 organizations to increase internship, apprenticeship, and work experience
17 opportunities. The department shall maintain records of the number of internship,
18 apprenticeship, and work experience opportunities subsidized within each funding
19 recipient.
20 SECTION 2. AMENDMENT. Section 54-60-17.1 of the North Dakota Century Code is
21 amended and reenacted as follows:
22 54-60-17.1. Internship fund - Continuing appropriation.
23 The internship fund is a special fund in the state treasury. All funds in the internship fund are
24 appropriated to the department of commerce on a continuing basis for the purpose of

1 implementing and administering section 54-60-17 and section 3 of this Act. Interest earned by
2 the fund must be credited to the fund.
3 SECTION 3. A new section to chapter 54-60 of the North Dakota Century Code is created
4 and enacted as follows:
5 Division of workforce development - Apprenticeship training program.
6 1. For purposes of this section, unless the context otherwise requires:
7 a. "Apprentice" means an individual at least sixteen years of age, except if a higher
8 minimum age is required by law, who is employed in an apprenticeable
9 occupation, a resident of the state, and registered in the state with the United
10 States department of labor, office of apprenticeship.
11 b. "Apprenticeable occupation" means an occupation approved for apprenticeship
12 by the United States department of labor, office of apprenticeship.
13 c. "Apprenticeship program" means a program registered with the United States
14 department of labor, office of apprenticeship, which includes terms and conditions
15 for the qualification, recruitment, selection, employment, and training of
16 apprentices, including the requirement for a written apprenticeship agreement.
17 d. "Apprenticeship sponsor" means an entity operating an apprenticeship program,
18 or an entity in which name an apprenticeship program is being operated, which is
19 registered with or approved by the United States department of labor, office of
20 apprenticeship.
21 e. "Lead apprenticeship sponsor" means a trade organization, labor organization,
22 employer association, or other incorporated entity representing a group of
23 apprenticeship sponsors.
24 2. The division of workplace development, in consultation with the superintendent of
25 public instruction, shall develop and implement an apprenticeship training program to
26 promote the development and expansion of apprenticeship programs in
27 apprenticeship occupations which may include providing a training grant to an
28 apprenticeship sponsor or a lead apprenticeship sponsor, and to educate students
29 about apprenticeship programs and training opportunities.
30 3. An apprenticeship sponsor or lead apprenticeship sponsor conducting an
31 apprenticeship program for apprentices who will be employed at worksites in the state

1 may apply to the division of workforce development for a training grant under this
2 section.
3 4. Financial assistance received by an apprenticeship sponsor or lead apprenticeship
4 sponsor under this section must be used for the cost of conducting and maintaining an
5 apprenticeship program.
